Ainda há esperança contra o “regime de ditadura judicial” imposta aos brasileiros, como reclamam metade da população que não gostaria de ver Lula no poder, mantido por um STF para lá de questionado.
A decisão do Supremo Tribunal Federal de “descondenar” o ex-presidente Lula foi mais do que uma reviravolta jurídica: foi um golpe profundo na credibilidade das instituições e nas esperanças de milhões de brasileiros que acreditaram na Lava Jato e na prisão de corruptos de alto escalão.
Como escancarou Eliana Calmon em entrevista à Arena Oeste, nesta quinta-feira (23), “A tese do CEP é absurda, mas foi utilizada para justificar a soltura. Essa foi a desculpa para desmoralizar a Lava Jato e permitir que Lula, condenado, voltasse para o jogo político”, disse a ex-ministra do STJ.
Fica claro, pelos bastidores narrados pela ex-ministra, que o STF cedeu ao clima de ameaças do então governo Bolsonaro: “Quando Bolsonaro falou em transformar o Supremo em corte constitucional, isso acendeu a luz vermelha dentro da Corte. Começaram então a articular uma saída para evitar esse risco, salvando Lula — única alternativa da esquerda”.
Essa “articulação interna não foi uma decisão solitária do ministro Fachin, mas sim um movimento político, estimulado pelas ameaças de Bolsonaro ao STF” prosseguiu Eliana Calmon.
No julgamento de abril de 2021, por 8 votos a 3, o Supremo ignorou anos de investigações e provas para aplicar uma manobra “técnica” — a tal incompetência de Curitiba — que nunca fez sentido para criminalistas sérios. Os ministros que decidiram pelo CEP deixaram claro, como denunciam analistas de direita, que o “condenado não é absolvido, mas não deve nada à Justiça”, criando um novo instituto jurídico que só existe para Lula.
Para Eliana Calmon, tudo se encaixa: “O bote para a salvação do Supremo chama-se Lula da Silva”, resumiu, apontando que a descondenação não passa de uma estratégia institucional para impedir a permanência de Bolsonaro e devolver o poder à esquerda.
A operação Lava Jato foi demolida, advogados vivem amedrontados diante de um Supremo protagonista político, e milhões de brasileiros assistem atônitos a parade de favorecimentos explícitos ao petista.
A história — que Eliana faz questão de lembrar — é clara: Lula estava condenado, inelegível, mas bastou uma articulação do STF para inverter tudo e transformar o condenado em presidenciável. Quando a Justiça se curva à geopolítica e interesses partidários, todos perdem. E o Brasil fica refém do voluntarismo dos togados em Brasília.
“O Supremo concentra um poder desmedido — e revida quando ameaçado”, dispara Eliana Calmon, sintetizando o sentimento de uma parcela do país que vê na Corte Suprema não o guardião da Constituição, mas o braço jurídico de um projeto político e ideológico. A descondenação de Lula, como lembra Calmon, é o capítulo mais escandaloso dessa novela — e ficará marcada como uma das maiores vergonhas do Judiciário nacional.
