Ex-presidente alega que o julgamento teve cerceamento de defesa, uso de uma delação “viciada” de Mauro Cid e erro jurídico por dupla punição, pedindo que os crimes de golpe de Estado e abolição violenta do Estado Democrático de Direito sejam tratados como um só
O ex-presidente Jair Bolsonaro apresentou um recurso ao Supremo Tribunal Federal (STF) pedindo a revisão da condenação que o responsabilizou pelos atos golpistas de 8 de janeiro de 2023. A defesa alega que o julgamento foi marcado por cerceamento de defesa, uso de uma delação “viciada e contraditória” do tenente-coronel Mauro Cid e erro jurídico na aplicação das penas.
A defesa também pede redução da pena.
O pedido foi protocolado na forma de embargos de declaração. Esta segunda é o último dia para as defesas apresentarem os recursos.
Embargos de declaração são um tipo de recurso que serve para contestar aspectos formais da condenação e esclarecer pontos específicos. Geralmente, mudam pouco o tamanho da pena.
Bolsonaro foi condenado em setembro pela Primeira Turma do STF por cinco crimes:
- golpe de Estado,
- tentativa violenta de abolição do Estado Democrático de Direito
- organização criminosa armada
- dano qualificado
- deterioração de patrimônio tombado

Redução da pena
Além disso, o recurso pede que o Supremo reconheça a absorção do crime de abolição violenta do Estado Democrático de Direito pelo de golpe de Estado, sob o argumento de que ambos tratam do mesmo conjunto de fatos e não podem gerar punição dupla.
Os advogados afirmam ainda que há “omissões e contradições” no acórdão e pedem a correção de erros materiais na dosimetria da pena.
Cerceamento de defesa
A defesa aponta que a equipe de advogados não teve tempo hábil para analisar as provas disponibilizadas — um acervo de mais de 70 terabytes de dados — e que o ministro Alexandre de Moraes, relator do caso, negou pedidos de adiamento das audiências.
Segundo os advogados, isso comprometeu o direito de defesa e a paridade de armas no processo.
Críticas à delação premiada
A defesa também sustenta que o julgamento se baseou em uma delação “sem credibilidade”, obtida sob pressão e repleta de contradições. Para os advogados, o depoimento de Mauro Cid não poderia ter servido como fundamento central da condenação.
“Ora, a prova da suposta ciência do ex-Presidente seria um áudio enviado por Mario Fernandes a Mauro Cid citando um encontro com o ex-presidente ocorrido nada menos que um mês depois. De fato, afirmações que prescindem da lógica não encontram a necessária prova”, escreveu a defesa.
Próximos passos
O STF não tem prazo para julgar os recursos. Eles são enviados ao ministro Alexandre de Moraes, relator do caso, que pode pedir manifestação da Procuradoria-Geral da República.
A expectativa é que Moraes já peça para o presidente da Primeira Turma, ministro Flávio Dino, que o julgamento dos questionamentos seja marcado.
Após a análise desses recursos, os advogados ainda podem entrar com um segundo embargo de declaração.
O Supremo tem como entendimento que, se os embargos seguintes forem considerados protelatórios, já pode ser determinada a execução da pena, ou seja, a prisão.
No STF, a expectativa é de que os recursos sejam analisados até o fim do ano, o que permitirá já o início do cumprimento da pena.
