A Câmara dos Deputados pode votar nesta terça-feira (11) o Marco Legal do Combate ao Crime Organizado, um substitutivo apresentado pelo deputado Guilherme Derrite (PP-SP) que tem gerado forte debate entre a base do governo e a oposição. O texto altera o projeto original do Executivo, reunindo dispositivos sobre crimes cometidos por organizações criminosas, grupos paramilitares, milícias e terrorismo.

Entre as medidas previstas, está a obrigatoriedade de que líderes dessas organizações cumpram pena em presídios de segurança máxima. O tempo mínimo para progressão de regime pode variar entre 70% e 85% do cumprimento da pena. Também estabelece penas maiores para quem integrar, financiar ou promover organizações criminosas qualificadas. Além disso, homicídios cometidos a mando de facções passam a ser crime hediondo, com penas de 12 a 30 anos.

A base do governo critica o substitutivo por considerar que ele banaliza o conceito de terrorismo e pode desestabilizar o sistema penal brasileiro. A Polícia Federal expressa preocupação com possíveis limitações à sua atuação, temendo enfraquecimento nas investigações. O governo busca dialogar com parlamentares e pediu que temas como golpes cibernéticos e fraudes via Pix sejam retirados do relatório.

Por outro lado, o substitutivo tem apoio de parlamentares ligados à segurança pública, incluindo delegados e policiais, e da oposição, que defendem o endurecimento das penas e a garantia de cumprimento em regime fechado e presídios de máxima segurança. O presidente da Câmara, Hugo Motta (Republicanos-PB), também defende o relatório, destacando seus avanços e o equilíbrio entre segurança e direitos.

No Congresso, a discussão é acirrada. A oposição bolsonarista critica o texto por não classificar facções como organizações terroristas. Um substitutivo alternativo, de Paulo Bilynskyj, propõe ampliar o combate ao crime organizado para áreas como mercados ilícitos, fluxos financeiros e logística criminosa, alterando diversas leis.

A votação do Marco Legal será decisiva para o enfrentamento do crime organizado no país. A proposta representa uma pauta estratégica para a segurança pública em meio às eleições presidenciais de 2026.

Motta escolheu como relator o deputado Guilherme Derrite (PP-SP) — que deixou a Secretaria de Segurança de São Paulo para reassumir o mandato —, decisão que desagradou integrantes do governo.

Antes de ser pautado, o texto ainda será discutido em pelo menos dois encontros nesta terça-feira. Motta vai se reunir com integrantes do governo, e a ministra da secretária de Relações Institucionais, Gleisi Hoffmann, deve conduzir a articulação para preservar o texto original do Executivo.
