O presidente do Supremo Tribunal Federal (STF), Edson Fachin arquivou a arguição de suspeição que questionava a atuação do ministro Dias Toffoli como relator das apurações sobre fraudes no Banco Master e seu controlador, Daniel Vorcaro.
O pedido surgiu de relatório da Polícia Federal, baseado em mensagens extraídas do celular apreendido de Daniel Vorcaro, autuado em 10 de fevereiro de 2026. O arquivamento foi no sábado (21).
A Corte entendeu não haver base jurídica para suspeição, especialmente após Toffoli deixar a relatoria em reunião administrativa de 12 de fevereiro.
Reunião dos ministros
Em reunião reservada no dia 12, os 11 ministros debateram o relatório da PF e decidiram pela redistribuição do inquérito a André Mendonça. Oficialmente
Toffoli saiu voluntariamente da relatoria, mas sem declaração formal de impedimento.
Os despachos e diligências autorizados por Toffoli seguem válidos, sem anulação de provas coletadas.
Não houve abertura de investigação contra o ministro, que pode atuar em julgamentos futuros sobre o caso no plenário.

As investigações miram irregularidades financeiras, lavagem de dinheiro e supostas propinas ligadas ao banco e empresas de Vorcaro.
Mensagens citam Toffoli e uma firma familiar, Maridt, em contexto de pagamentos no resort Tayayá, negados pelo ministro como ilícitos.
As ligações entre Dias Toffoli, o resort Tayayá e Daniel Vorcaro envolvem negócios societários familiares e mensagens identificadas pela Polícia Federal.
Relação societária via Maridt
Toffoli é sócio da Maridt Participações, empresa de seus familiares, que tinha 33% do resort Tayayá, em Ribeirão Claro (PR), até 2025.
A Maridt vendeu a participação em 2021 para o Fundo Arleen, ligado ao Banco Master, com aporte de R$ 4,3 milhões e participação de empresa controlada pelo cunhado de Vorcaro.
Toffoli declarou os dividendos como lícitos e negou amizade íntima ou irregularidades com Vorcaro.
Mensagens e contatos da PF
Relatório da PF apontou mensagens de Vorcaro e seu cunhado sobre pagamentos a Toffoli, possivelmente ligados ao Tayayá.
Registros mostram ligações telefônicas entre eles e um convite de Toffoli para festa de aniversário, indicando proximidade.
Vorcaro mencionou em conversas ter pago R$ 35 milhões ao resort sob cobrança.
Resposta de Toffoli
O ministro chamou as citações de “ilações desconexas”, destacou que a Maridt é gerida por familiares e assumiu a relatoria do caso Master só após a venda.
Não houve pedido formal de afastamento no relatório, mas isso gerou a arguição de suspeição e sua saída voluntária da relatoria.
Dias Toffoli tem irmãos e primos diretamente ligados à Maridt Participações, empresa central no negócio do resort Tayayá.

José Eugênio Dias Toffoli é diretor-presidente da Maridt, sediada em sua casa em Marília (SP), com capital social de R$ 150.
José Carlos Dias Toffoli, conhecido como Padre Carlão, foi diretor-presidente inicial até 2023, quando passou o cargo ao irmão.
Igor Luiz Pires Toffoli, filho de José Eugênio e sobrinho de Dias Toffoli, atua como diretor desde março de 2023.
Primo envolvido
Mario Umberto Degani, primo de Dias Toffoli, integrou a sociedade do Tayayá e vendeu sua parte em setembro de 2025 para Paulo Humberto Barbosa, advogado ligado à J&F.
Participações no Tayayá
A Maridt deteve até 33% das cotas do resort entre 2020 e 2025, vendidas em etapas: parte ao Fundo Arleen (ligado ao Banco Master) em 2021, e o restante à PHD Holding em fevereiro de 2025.
Outros irmãos, como José Carlos, tiveram participações indiretas via Maridt em resorts relacionados, como Tayayá Porto Rico (18% entre 2021-2025).
